Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AllSpice POS website, software, and related services (collectively, the "Services") provided by AllSpice POS ("AllSpice", "we", "our", or "us"). By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at admin@allspicepos.com.
3. Acceptable use
- Do not use the Services for any unlawful, harmful, or fraudulent purpose.
- Do not attempt to interfere with, compromise, or disrupt the Services.
- Do not reverse engineer or attempt to extract source code, except as permitted by law.
- Do not use the Services to send spam or unsolicited communications.
4. Fees and payment
Paid plans are billed in advance on a monthly basis unless otherwise agreed in writing. Fees are non-refundable except as expressly set out in our Refund Policy. You authorize us to charge your designated payment method for all applicable fees and taxes.
5. Subscription and cancellation
Your subscription continues until cancelled. You may cancel at any time from your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.
6. Intellectual property
The Services, including all software, text, graphics, and trademarks, are owned by AllSpice or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
7. Customer data
You retain all rights in the data you submit to the Services. You grant us a limited license to host, process, and display your data solely to provide the Services to you.
8. Third-party services
The Services may integrate with third-party products. We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLSPICE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ALLSPICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless AllSpice and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services if you violate these Terms or if necessary to protect the Services or other users.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Lehigh County, Pennsylvania.
14. Changes to these Terms
We may modify these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
